Common terrace converted into a private terrace, construction in the service area as well; questions are being raised about everyone from the architect to the monitoring system

The Jaipur Development Authority (JDA) enforcement squad took major action against building regulation violations in Zone 10, demolishing illegal construction in Felicity Rugantaz Aventura, which was built in violation of building regulations. According to the JDA, the construction on the 18th floor rooftop was carried out in violation of building regulations. Furthermore, the common terrace was allegedly being used as a private terrace.
According to Deputy Inspector General of Police Anand Sharma, teams were formed under the direction of the Chief Controller of Enforcement-1 and action was taken on September 28th at Felicity Rugantaz Aventura, located in village Todi Ramzanipura, Tehsil Sanganer. The enforcement squad demolished the commercial construction that was built in violation of the approved map.
According to the JDA, the flats located in the service area on the fourth floor of the building’s C-Block and the commercial construction in the ground-level common area were also included in the action. The enforcement squad removed the identified construction with the help of a barbed wire machine and laborers.
A major question after the action: Where was the monitoring system when so much construction took place?
The biggest question now arising after the JDA’s action is: if the construction was contrary to the approved map and there were serious violations of building regulations, what was the role of the monitoring system of the relevant officials and technical staff during the construction?
Why were such matters as construction on the 18th floor roof and the change in the use of the common terrace not detected in time? Was the construction periodically inspected by the relevant JDA zone office? If an inspection was conducted, what report was prepared at that time, and if not, who will be held responsible for it? These questions are now being raised after the action.
*Demand for investigation into the role of the architect*
There are calls for an investigation into the role of the building’s architect. It is important to determine at what stage the construction was carried out contrary to the approved plan, and whether the architect supervised the construction or provided any certification that it was in accordance with the approved plan.
If a competent investigation reveals violations of rules, incorrect certifications, or other professional irregularities on the part of the architect, action should be taken against him as per the rules, including the suspension or cancellation of his registration/license.
*Investigation needed from map approval to construction monitoring*
The matter should not be limited to demolition of illegal constructions. The investigation should also include the basis on which the original plan was approved, which officer or technical team conducted the inspection during construction, when and how the changes to the common areas occurred, and when the JDA became aware of the illegal construction.
If negligence or violation of rules is found at any level, responsibility should be fixed and action should be taken against the concerned officer, technical staff, or other responsible party as per the rules. This could help curb future tampering with approved maps for large residential and commercial projects.
According to the JDA, the demolition costs will be recovered from the parties involved as per regulations. The action was carried out under the supervision of the Chief Controller of Enforcement-1, in the presence of the Deputy Controller of Enforcement-3, relevant enforcement officers, and JDA revenue and technical staff.
